1.2. BUYER<\/p>\n
The BUYER\u2019s full name, delivery address, billing address, telephone number, and email address are the details provided by the BUYER when placing the order.<\/p>\n
Hereinafter referred to as the \u201cBUYER\u201d.<\/p>\n
2. SUBJECT OF THE AGREEMENT<\/p>\n
The subject of this Agreement is to regulate the sale and delivery of the products electronically ordered by the BUYER through the SELLER\u2019s website, https:\/\/elfelora.shop, and to determine the rights and obligations of the parties.<\/p>\n
This Agreement has been prepared in accordance with Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.<\/p>\n
3. PRODUCT AND ORDER INFORMATION<\/p>\n
The main characteristics, size, colour and quantity of the purchased product, its sales price including VAT, delivery charges, and the total order amount are displayed on the product page, in the shopping cart, and on the order summary screen.<\/p>\n
The BUYER declares that they have reviewed and accepted this information before confirming the order.<\/p>\n
4. PAYMENT<\/p>\n
The BUYER pays the order amount using a credit card, debit card, or one of the other payment methods available on the website.<\/p>\n
The currency and total amount displayed during payment constitute the principal amount of the order approved by the BUYER.<\/p>\n
For instalment payments, the terms and conditions applied by the relevant bank or payment service provider shall apply.<\/p>\n
5. DELIVERY<\/p>\n
The product will be sent to the delivery address provided by the BUYER when placing the order.<\/p>\n
The order will be delivered within the promised period and, in all cases, within the statutory maximum period of 30 days.<\/p>\n
If the procurement or delivery of the product becomes impossible, the SELLER will notify the BUYER and refund the collected payment within the statutory period.<\/p>\n
The BUYER is responsible for delivery problems caused by providing an incorrect or incomplete address.<\/p>\n
6. RIGHT OF WITHDRAWAL AND RETURNS<\/p>\n
The BUYER may exercise the right of withdrawal within 14 days from the date of receiving the product, without providing any reason or paying a penalty.<\/p>\n
The withdrawal request must be clearly submitted to the following email address:<\/p>\n

The BUYER must return the product to the SELLER within 14 days of submitting the withdrawal notice.<\/p>\n
For returns that comply with the right of withdrawal, the SELLER will cover the return shipping cost, provided that the return method specified by the SELLER is used. The SELLER will provide the BUYER with the necessary shipping information for the free return.<\/p>\n
Within 14 days of receiving the withdrawal notice, the SELLER will refund all payments collected, including the standard delivery cost, using a payment method compatible with the payment method used by the BUYER.<\/p>\n
The BUYER may only try the product to the extent necessary to inspect it as they would in a physical store. The BUYER may be responsible for any loss in value resulting from using the product outdoors, washing, staining or damaging it, or using it beyond the limits of a normal inspection.<\/p>\n
The returned product must be sent with its invoice and any accessories supplied with it.<\/p>\n
7. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL<\/p>\n
Under the applicable legislation, the right of withdrawal cannot be exercised for the following products:<\/p>\n
a) Products specially manufactured according to the BUYER\u2019s requests or personal measurements, or products that have been specially altered.<\/p>\n
b) Products whose packaging, seal, tape, or protective seal has been opened after delivery and which are unsuitable for return for hygiene reasons.<\/p>\n
c) Products that may deteriorate quickly or whose expiry date may pass.<\/p>\n
Dresses and clothing products sold in standard size options and not personally altered are not considered customised products merely because the BUYER selected a size.<\/p>\n
8. DEFECTIVE OR INCORRECT PRODUCTS<\/p>\n
If the product is defective, damaged, incorrect, or different from the product ordered, the BUYER may contact the SELLER.<\/p>\n
The BUYER\u2019s rights regarding defective products arising from Law No. 6502 on Consumer Protection remain reserved.<\/p>\n
9. OBLIGATIONS OF THE BUYER<\/p>\n
The BUYER accepts that the information provided when placing the order is accurate and complete.<\/p>\n
The BUYER accepts that they have read and electronically approved the product price, delivery information, Preliminary Information Form, and this Distance Sales Agreement.<\/p>\n
10. PERSONAL DATA<\/p>\n
The BUYER\u2019s personal data is processed for the purposes of creating the order, receiving payment, completing delivery and return procedures, and fulfilling legal obligations.<\/p>\n
Detailed information about the processing of personal data is provided on the \u201cPrivacy Policy and KVKK Information Notice\u201d page available on the website.<\/p>\n
11. FORCE MAJEURE<\/p>\n
Natural disasters, war, epidemics, interruptions to transport or communication, decisions by public authorities, and similar circumstances beyond the control of the parties shall be considered force majeure.<\/p>\n
The parties cannot be held responsible if their obligations cannot be fulfilled due to force majeure.<\/p>\n
12. RESOLUTION OF DISPUTES<\/p>\n
For disputes arising from this Agreement, the BUYER may apply to the Consumer Arbitration Committee located in the BUYER\u2019s place of residence or the place where the transaction was completed, within the applicable annual monetary limits.<\/p>\n
Consumer Courts shall have jurisdiction over disputes exceeding the applicable monetary limit. In cases required by law, applying for mediation before filing a lawsuit is mandatory.<\/p>\n
13. ENTRY INTO FORCE<\/p>\n
By completing the order through the website, the BUYER declares that they have read, understood, and electronically accepted the Preliminary Information Form and this Distance Sales Agreement.<\/p>\n
This Agreement enters into force on the date the BUYER electronically confirms the order.<\/p>\n
